Terms of Service

PicSecure is pre-launch. Today, these terms mainly govern your use of this website and the early-access waitlist. The sections describing in-app conduct and Guardian will take effect once the app itself launches.
1. Acceptance of these terms
By using this website, joining the waitlist, or (once launched) creating a PicSecure account, you agree to these Terms of Service. If you don't agree, please don't use PicSecure.
2. Description of service
PicSecure is a communication platform providing end-to-end encrypted messaging, calling, and file storage, along with optional safety features (Guardian) and family-connection tools (Family Space). Some features described on this website are still in development and may change before launch.
3. Eligibility
You must be at least 13 years old to create your own PicSecure account. Family Space is designed so a parent or guardian can help connect a younger family member, subject to applicable law and verified parental consent where required.
4. The waitlist
Joining the waitlist reserves you a place to be notified at launch. It is not a guarantee of access by any specific date, and we may open access in stages.
5. Your account (once launched)
- You're responsible for keeping your device and credentials secure — because of our zero-knowledge design, we cannot recover encrypted content if you lose access to your device and keys.
- You agree to provide accurate information when creating an account.
- You're responsible for activity that happens under your account.
6. Acceptable use
You agree not to use PicSecure to:
- Violate any applicable law;
- Harass, threaten, or harm another person;
- Distribute malware, spam, or unlawful content;
- Attempt to break, bypass, or reverse-engineer PicSecure's encryption or security controls, except through a responsible disclosure process we may publish;
- Impersonate another person or misrepresent your affiliation with any person or entity.
Because messages are end-to-end encrypted, we generally cannot see content to enforce this section proactively — enforcement typically relies on reports from users.
7. Reporting, blocking, and abuse
PicSecure may provide tools that allow users to block other users and report suspected abuse, harassment, impersonation, spam, threats, illegal activity, or other violations of these Terms.
Because private communications are protected by end-to-end encryption, PicSecure generally cannot proactively monitor or read message content. When a user voluntarily submits a report, the information included in that report may be reviewed to the extent necessary to investigate the reported conduct.
Where appropriate and permitted by law, we may take account-level or service-level action, including warnings, feature restrictions, suspension, or termination. We may also respond to valid legal requests where required by applicable law, subject to the technical limitations created by our end-to-end encryption architecture.
8. Guardian is not an emergency service
Guardian (Danger, Medical, Travel, and Customize modes) is designed to help you share your location and status with contacts you choose. It is a convenience feature, not a substitute for calling local emergency services (such as 911 or your local equivalent). Message and location delivery depend on network connectivity and device conditions outside our control, and we cannot guarantee delivery in every circumstance. In a genuine emergency, always contact emergency services directly first.
Guardian relies on technologies and services that may be outside PicSecure's control, including GPS and other location services, mobile networks, internet connectivity, device permissions, battery availability, operating-system restrictions, push-notification services, and, where applicable, SMS or telecommunications providers.
Location information may be delayed, unavailable, or inaccurate, and alerts or messages may fail to reach a trusted contact. PicSecure does not guarantee that Guardian will successfully detect an emergency, determine your precise location, contact another person, or deliver an alert within any particular period of time.
Guardian should therefore be used only as an additional safety and communication tool. It is not a replacement for emergency services, professional medical assistance, law enforcement, or other official emergency-response systems.
9. Family Space
Family Space is built on mutual, visible connections — not one-directional tracking. Location or status sharing between family members requires both sides to opt in, and can be turned off at any time by either party.
10. Family Space, minors, and parental responsibility
Family Space is intended to help families maintain voluntary and visible connections. Parents and guardians are responsible for ensuring that their use of Family Space with minors complies with applicable laws, including any requirements relating to parental consent.
PicSecure is not intended to enable covert surveillance of children, family members, or any other person. Features involving location or status sharing are designed to provide appropriate visibility and controls to participating users.
Age requirements, parental-consent mechanisms, and the availability of specific Family Space features may vary by country or region. PicSecure may restrict or modify these features where necessary to comply with applicable law.
11. Intellectual property
PicSecure's branding, design, and software are owned by PicSecure and its licensors. These terms don't grant you any rights to our trademarks or branding beyond what's needed to use the app normally.
12. Your content and ownership
You retain ownership of the messages, photos, videos, documents, audio, and other content that you create, upload, store, send, or share through PicSecure ("Your Content"). These Terms do not transfer ownership of Your Content to PicSecure.
You grant PicSecure only the limited rights necessary to operate and provide the service, such as transmitting, routing, temporarily storing, synchronizing, and delivering encrypted data as required for the features you choose to use. Where Your Content is protected by end-to-end encryption, PicSecure does not receive a license to access, read, analyze, or use the decrypted content.
You are responsible for ensuring that you have the necessary rights and permissions to upload, send, store, or share Your Content and that your use of PicSecure complies with applicable law and the rights of others.
13. Copyright and intellectual property complaints
We respect intellectual property rights and expect PicSecure users to do the same. If you believe that material associated with PicSecure infringes your copyright or other intellectual property rights, you may contact us at hello.team@picsecure.in with the subject "Copyright Notice."
Please include, where applicable:
- A description of the copyrighted work or intellectual property you believe has been infringed;
- Sufficient information to identify or locate the material at issue, where technically possible;
- Your name and contact information;
- A statement explaining why you believe the use is unauthorized;
- A statement that the information in your notice is accurate and that you are authorized to act on behalf of the rights holder; and
- Your physical or electronic signature, where required.
A note on end-to-end encryption: PicSecure is designed so that we cannot read the content of end-to-end encrypted chats, calls, or encrypted files. As a result, we may not be technically capable of locating, reviewing, or removing specific encrypted content stored only on users' devices or otherwise inaccessible to us.
Where content is publicly hosted by PicSecure or is otherwise technically accessible to us, we may review valid intellectual property complaints and take appropriate action in accordance with applicable law.
If PicSecure becomes eligible for and chooses to rely on a statutory copyright safe-harbor framework that requires registration of a designated copyright agent, we will publish the applicable agent information and procedures on this website.
14. Third-party services
PicSecure may link to or integrate with third-party services (such as app stores). We aren't responsible for the content or practices of third-party services.
15. Payments, subscriptions, and paid services
PicSecure may offer optional paid features, subscriptions, storage plans, or other premium services in the future. The applicable price, billing period, included features, renewal terms, and any available trial terms will be disclosed before you complete a purchase.
If a subscription automatically renews, you will be informed of the renewal terms before purchase and may cancel future renewals using the method made available through PicSecure or the applicable app-store or payment provider.
Purchases processed through third-party platforms, including mobile app stores, may also be subject to the payment, cancellation, and refund policies of those platforms. Taxes may apply depending on your location and applicable law.
Any refund rights provided by applicable consumer-protection law will continue to apply. Additional PicSecure-specific billing and refund terms, if any, will be published before paid services are launched.
16. Account suspension, termination, and deletion
You may stop using PicSecure at any time. Once account functionality is available, you may also request or initiate deletion of your account as described on our Delete Account page.
We may restrict, suspend, or terminate access to PicSecure where reasonably necessary to address serious or repeated violations of these Terms, protect users or the security of the service, comply with applicable law, or respond to fraudulent or abusive activity.
Account deletion generally removes account information associated with your account, subject to limited retention where required or permitted by applicable law. Messages or content you previously sent to other users may remain on their devices where PicSecure cannot technically control or retrieve those copies.

17. Disclaimers
PicSecure is provided "as is." While we design PicSecure to be secure and reliable, we don't guarantee it will be uninterrupted, error-free, or immune from all security risks — no communication platform can make that guarantee.
18. Limitation of liability
To the maximum extent permitted by law, PicSecure will not be liable for indirect, incidental, or consequential damages arising from your use of the service, including reliance on Guardian in an emergency (see Section 8).
19. Changes to these terms
We may update these terms as PicSecure develops. We'll update the "Last updated" date above, and for material changes we'll make a reasonable effort to notify you.
20. Governing law & dispute resolution
These terms will be governed by the laws of the jurisdiction in which PicSecure is legally established, to be specified before public launch.
If a dispute arises, we'd like the chance to resolve it directly first: contact us at hello.team@picsecure.in and we'll make a good-faith effort to work it out informally within 30 days.
If informal resolution doesn't work, disputes will be resolved through binding arbitration on an individual basis rather than in court, except that either party may bring an individual claim in small claims court instead. This means:
- Arbitration will be conducted by a neutral arbitrator instead of a judge or jury;
- You and PicSecure each waive the right to a jury trial;
- Claims must be brought individually, not as part of a class, collective, or representative action;
- The specific arbitration provider, rules, and location will be finalized and published here before public launch.

Note: This is a working draft prepared ahead of launch. Please have it reviewed by a qualified attorney — especially Sections 8 (Guardian/emergency disclaimers), 10 (Family Space/minors), 13 (copyright — a designated agent should only be named once formally registered), 15 (payments), 18 (liability), and 20 (governing law & arbitration — the specific jurisdiction and arbitration provider still need to be finalized) — before PicSecure goes live.
